Canadian Torrent Site 1st To Fight Holloywood Litigants on Piracy Charges

It’s finally happened….Hollywood finally has hit a Canadian torrent site called isoHunt.com with priacy charges in an effort to close it down, just like Napster and others before it.  But this time, the site’s owner is putting up a fight according to CBC news programme "The National" in a segment aired last night.  The sight’s owner who goes by the nickname "IH" on his site at isoHunt.com points out he’s not doing anything illegal just sharing .torrent files on his site, which only tell others where to get free downloads of movies and software.  That’s not against the law in Canada, and since the technology is freely available and of a nature that allows people to decide for themselves what to download, he’s not doing anything wrong.
 
But the litigants in the case (an association of Hollywood movie producers) disagree and argue that not seeking permission from the producers of the movies before telling everyone where to get free versions of them makes it illegal.
 
Frankly, these guys have always been out of their minds so far as I’m concerned.  The technology referred to above (BitTorrent) is a peer-to-peer or"P2P" networking technology that needs to be kept free. Otherwise we’re letting the authorities and government dictate not only what we download but how we go about doing it and that’s just too far.  What’s to stop them from imposing bans on other kinds of new, innovative technolgies?  P2P technologies like torrents have legitimate purposes too and the fact piracy is conducted using the technology is not an entirely valid arument against a site passing .torrent files around.
 
I’m guessing it’s likely"IH" will win his initial battles in court since the current law in Canada doesn’t expressly forbid websites like isoHunt.com.  Hopefully, IH is prepared to go all the way to the Supreme Court if need be with this one.  I believe the stakes for all of us are just that high it might be necessary.
